SBA Towers – They Called, So Now What?

SBA Communications Corporation is an American company founded in 1989, and is based out of Boca Raton, Florida. SBA owns and operates wireless communications towers, primarily in the United States, Canada, Costa Rica, El Salvador, Guatemala, Nicaragua, and Panama, and currently is the third largest cell tower operator and developer in the United States.

SBA presently operates over 15,000 tower sites in the United States and over 2,500 additional tower sites abroad, mostly being concentrated in Latin America.

SBA-New Cell Tower Lease: SBA is continuing its expansion across the globe. If SBA has approached you to discuss a cell tower or other wireless equipment on your property, you need to first establish what their bargaining power is in this transaction and what the true value of the use of your property really is.SBA-Lease Buyout Request: SBA lease purchase program is gaining steam, as they are making a concerted effort to secure their cell tower sites due to the vast majority of their revenues being directly tied in to keeping their towers up and running, without interruption or costly relocation. SBA will typically structure a lease buyout as a simple, lump sum payment for both assigning a property owner’s remaining rights under their cell tower lease and also exchanging the current lease to a long-term tower easement.

SBA-Cell Tower Lease Extensions: SBA Towers cell site leases, currently over 30% of all current cell tower leases, have less than ten (10) years remaining on their current lease terms. SBA is continuing to seek long-term lease extensions to their present cell tower leases. SBA requests a landowner to extend their land lease sometime upwards of 40 or more years. SBA most typically demands a lease term extension for a small signing bonus and/or a small increase in cell tower rent. The decision a cell tower landlord makes regarding a cell lease extension may mean hundreds of thousands of dollars over the life of is lease, as a few hundred dollars more a month means a lot when paid over 10, 20 or more years. This is an important transaction and should not be taken lightly.

 

SBA-Consent/Expansions Inquires: SBA has made pronouncements that it is upgrading its existing cell tower sites due to its wireless carrier requests across North America. As a result of these upgrades, a cell tower landlord may expect a request to expand the existing leased area. SBA may also be obligated to obtain certain consent rights to allow them to handle additional co-locators on the tower that they own, so as to generate more rent revenue. A property owner should understand what is truly being asked of him/ her and the opportunity to not only increase rent, but to get a better overall lease with SBA Towers.
